PUBLIC OFFER AGREEMENT

This Agreement between Sole Proprietor Shcherbak O.M. (hereinafter referred to as the "Online Store") and the user of the Online Store's services (hereinafter referred to as the "Customer") is a commission agreement for the purchase and delivery of goods through the website https://sweetvillage.com.ua.

1. General Provisions

1.1. This Agreement is a public offer (in accordance with Articles 633 and 641 of the Civil Code of Ukraine), and its terms are the same for all Customers regardless of status.

1.2. The Agreement is considered concluded from the moment the Customer clicks the “Place Order” button on the checkout page. By concluding this Agreement, the Customer fully accepts its terms.

2. Terms and Definitions

2.1. Online Store – an online shop hosted on the website https://bakerstreet.ua, with temporary usage rights belonging to Sole Proprietor Shcherbak O.M., located at: Sofiivska Borshchahivka, Heroes of the Heavenly Hundred Avenue, 36.

2.2. Goods – the list of products published on the Online Store's website, sold by Sole Proprietor Shcherbak O.M.

2.3. Customer – an individual, legal entity, or sole proprietor who, by using the Online Store's website, commissions the Online Store to purchase and deliver goods.

2.4. Order – a registered and placed request on the Online Store’s website authorizing a courier or another third party, designated at the sole discretion of the Online Store without Customer approval, to purchase goods from Sole Proprietor Shcherbak O.M. and deliver them on behalf and at the expense of the Customer.

2.5. Acceptance of the Offer – full and unconditional acceptance of the offer by the Customer through order placement on the Online Store’s website.

2.6. Personal Account – a section on the Online Store's website accessible to the Customer, displaying personal information and order history.

2.7. Website – the webpage https://sweetvillage.com.ua, with temporary usage rights belonging to Sole Proprietor Shcherbak O.M., displaying the product list and prices, through which the Customer may place an Order.

3. Subject of the Agreement

3.1. This Agreement is a commission contract (in accordance with Article 1000 of the Civil Code of Ukraine). By selecting Goods and ordering their delivery, the Customer authorizes a courier or another third party, designated at the Online Store’s discretion, to purchase the selected Goods from Sole Proprietor Shcherbak O.M. and deliver them to the specified address. If necessary, the courier may also accept cash from the Customer to pay for the Goods.

3.2. The price of the Goods is determined and specified by the Online Store on the Website.

4. Customer Registration on the Website

4.1. Customer registration on the Website is required to grant access to personalized information and additional features of the Website through an Account.

4.2. During registration, the Customer provides the following data:

Full Name;
Phone number;
Email address;
Address;
Password.

4.3. The Customer must provide accurate and complete information.

4.4. After registration, the Customer gains access to the Personal Account.

4.5. The Customer agrees not to disclose registration details to third parties and is responsible for password confidentiality and any actions taken on the Website under their Account.

4.6. The Online Store may deny services if it has reason to believe the Customer provided false information or engaged in unfair practices (e.g., violating this Agreement).

4.7. The use of the Website for illegal or prohibited activities is strictly forbidden.

4.8. In addition to the data provided in clause 4.2, the Online Store may collect the following Customer information:

Delivery address;
Preferences and interests;
Other relevant data.

4.9. By registering on the Website or placing an Order, the Customer voluntarily consents to the processing and use of personal data, including its transfer, without time limitation, in accordance with Ukrainian law.

4.10. The Online Store uses personal data to promote its services, including automated data processing, and will not disclose this information.

4.11. If the Customer wishes to revoke consent for personal data processing, they must contact customer support.

4.12. By registering or placing an Order, the Customer agrees to receive notifications via SMS and email from the Online Store and its partners.

4.13. The Customer may opt out of such notifications at any time through their Personal Account settings.

5. Order Placement and Payment

5.1. The Customer places an Order independently on the Website by adding selected Goods to the virtual cart, entering the delivery address, and clicking "Order."

5.2. All Customers, regardless of registration, may place an Order on the Online Store.

5.3. Delivery is available from 10:00 to 16:00, Monday to Saturday.

5.4. Goods are prepaid at the time of order placement via bank transfer or paid upon delivery in cash to the courier or another designated third party after verifying the received Goods.

5.5. The commission is carried out by the courier or another designated third party free of charge, but the Customer must fully pay for the Goods or reimburse expenses incurred for their purchase.

5.6. The total cost of the Order includes the full price of the Goods and reimbursement of actual expenses incurred for its purchase. The final amount is confirmed by the Online Store before Order execution.

5.7. Upon delivery, the Customer receives the following documents from the courier or designated third party:

An invoice confirming the expenses incurred for the execution of the Order.

5.8. Customers must check with the Online Store regarding delivery outside Kyiv.

5.9. The possibility of self-pickup should be clarified with the Online Store operator.

6. Return Policy

6.1. The Online Store fulfills the Customer’s commission by purchasing and delivering the Order at the specified time and location.

6.2. If defective Goods are found, the Customer has the right to request:

Replacement with a similar item of proper quality;
Exchange for another item with a price adjustment;
A refund.

7. Other Provisions

7.1. The Website contains legally protected materials, including but not limited to text, photographs, and graphics. All content is protected by Ukrainian law.

7.2. The Customer may use the Website’s materials only for order placement and is prohibited from modifying, publishing, transmitting to third parties, selling, licensing, or creating derivative works.

7.3. This Agreement is governed by Ukrainian law.

7.4. The Online Store reserves the right to amend the text of this Agreement at its discretion at any time without prior notice to Customers
